If the Defendant shall make default in filing his answer within the time limited by the last preceding rule he shall not be at liberty, except by leave of the Court or Judge, to dispute any of the facts alleged in the Plaintiff’s petition, and the Plaintiff may, at any time after the Defendant has so made default, apply to have the action set down for hearing, and the Court or Judge may give such judgment as the Plaintiff may appear to be entitled to upon the facts alleged in his petition.
